Welcome to Deviora. These Terms and Conditions govern your use of our professional photography and videography services. By engaging our services, you agree to be bound by these terms.

1. Acceptance of Terms

By booking any services with Deviora ("Company," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Deviora.

If you do not agree with any part of these terms, please do not engage our services. These terms apply to all clients, regardless of the type or scale of photography or videography services requested.

2. Service Descriptions

2.1 Photography Services

We provide professional photography services including but not limited to:

  • Wedding and engagement photography
  • Corporate and event photography
  • Portrait and headshot photography
  • Commercial and product photography
  • Family and lifestyle photography

2.2 Videography Services

Our videography services include:

  • Wedding and ceremony videography
  • Corporate video production
  • Event highlight reels
  • Commercial and promotional videos
  • Documentary-style filming

2.3 Service Customization

All services are customized based on client requirements. Final deliverables, timelines, and pricing are confirmed in writing before service commencement. We reserve the right to decline services that fall outside our expertise or ethical guidelines.

3. Booking, Payment, and Deposits

3.1 Booking Confirmation

All bookings require a signed contract and deposit to secure your date. Verbal agreements are not binding. Your booking is confirmed only upon receipt of the signed contract and required deposit payment.

3.2 Payment Terms

  • Deposit: A non-refundable deposit of 25-50% is required to secure your booking date
  • Balance: Final payment is due no later than 7 days before your event or session
  • Late Payments: Late payment fees may apply for payments received after the due date
  • Payment Methods: We accept cash, check, credit cards, and electronic transfers

3.3 Additional Costs

Additional costs such as travel expenses, accommodation, equipment rental, or overtime charges will be clearly outlined in your contract. Rush delivery fees may apply for expedited editing and delivery requests.

4. Cancellation and Rescheduling Policy

4.1 Client Cancellations

  • More than 60 days: 50% refund of total contract value (deposit forfeited)
  • 30-60 days: 25% refund of total contract value
  • Less than 30 days: No refund, full payment due
  • Same day: Full payment due, no exceptions

4.2 Rescheduling

Rescheduling is permitted up to 30 days before your event subject to photographer availability. Rescheduling within 30 days may incur additional fees. Weather-related rescheduling for outdoor sessions is accommodated without penalty.

4.3 Deviora Cancellations

In the unlikely event we must cancel due to illness, emergency, or other unforeseen circumstances, we will provide a full refund or help arrange a qualified replacement photographer at no additional cost.

5. Copyright and Usage Rights

5.1 Ownership

Deviora retains full copyright ownership of all photographs and videos created during your session or event. This includes the right to use images for portfolio, marketing, social media, and promotional purposes.

5.2 Client Usage Rights

Upon full payment, clients receive personal usage rights including:

  • Personal sharing on social media with photo credit
  • Personal prints for family and friends
  • Display in home or personal office
  • Wedding announcements and save-the-date cards

5.3 Commercial Usage

Commercial usage rights require separate licensing agreements and additional fees. This includes but is not limited to advertising, promotional materials, websites, publications, or resale purposes.

5.4 Model Release

By engaging our services, clients grant permission for use of their likeness in photographs and videos for Deviora's promotional purposes. If you prefer not to be featured in our marketing materials, please notify us in writing.

6. Limitation of Liability

6.1 Service Limitations

Deviora's liability is limited to the total amount paid for services. We are not responsible for lost profits, incidental, consequential, or punitive damages arising from our services or any failure to provide services.

6.2 Equipment Failure

While we maintain backup equipment and redundant systems, we cannot guarantee delivery if catastrophic equipment failure occurs. In such cases, our liability is limited to a full refund of payments received.

6.3 Third-Party Venues

We are not responsible for restrictions imposed by venues, officiants, or other vendors that may limit our ability to photograph or film. Clients are responsible for informing us of any venue restrictions prior to the event.

6.4 Data Loss

While we implement multiple backup systems, we recommend clients backup their delivered images and videos. We are not responsible for data loss after delivery to the client.

7. Force Majeure

Deviora shall not be liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather conditions
  • Government regulations or restrictions
  • Public health emergencies or pandemics
  • Transportation strikes or disruptions
  • Acts of war, terrorism, or civil unrest
  • Serious illness or injury of photographer

In such cases, we will work with clients to reschedule or provide alternative solutions. If rescheduling is not possible, a full refund will be provided.

8. Modifications to Terms

Deviora reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with the revision date. Clients with existing contracts will be governed by the terms in effect at the time of booking.

Any modifications to individual contracts must be made in writing and signed by both parties. Verbal modifications are not binding.

9. Governing Law

These Terms and Conditions are governed by the laws of British Columbia, Canada. Any disputes arising from these terms or our services shall be resolved in the courts of British Columbia.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
